Terms & Conditions

Please read these Terms & Conditions carefully before using GiftBasketsSpain.es or placing an order. By accessing our website or completing a purchase, you agree to be bound by these terms. If you do not agree, please do not use our services.

1. Orders & acceptance

By placing an order on GiftBasketsSpain.es, you make an offer to purchase the selected gift baskets or hampers from GiftBasketsSpain.es S.L., a company incorporated in Spain. Orders are accepted at our discretion and confirmed by email, which constitutes our acceptance and forms a binding contract.

2. Delivery & cut-off

We deliver nationwide across mainland Spain, the Balearic Islands and the Canary Islands. Same-day delivery is offered in major cities on orders placed before 2:00 PM (Madrid time), subject to courier availability.

• Same-day: 2:00 PM cut-off in select cities, delivered the same working day.
• Standard: next-day delivery in metropolitan areas for orders placed before 11:00 AM.
• Scheduled: any future date you choose at checkout.

3. Substitution policy

The contents of any gift basket may be substituted with items of equal or greater value, and of comparable character and seasonal appropriateness, where individual components are unavailable, without prior notice.

4. Payment & currency

Prices are displayed in Euros (€) and include Spanish VAT (IVA) at the applicable rate. You can switch to other major currencies at checkout, and you are charged in the currency you select. Accepted methods: Visa, Mastercard, American Express and PayPal.

5. Cancellation & refunds

You may cancel an order any time before preparation begins for a full refund. Orders cancelled within 24 hours of the scheduled delivery date are subject to a 50% cancellation fee, as preparation will already have started. Refunds are returned to your original payment method.

6. Quality guarantee

If your gift arrives in less-than-perfect condition, contact us through our form within 48 hours with a photo and we will replace it, refund you, or offer store credit — your choice.

7. Privacy & data

We collect only the data we need to fulfil your order, in accordance with the EU GDPR and Spanish data-protection law. We never sell your data. Request a copy or deletion through our contact form.

8. Cookies

We use first-party cookies for cart persistence and sessions, and analytics cookies (GA4) which you can opt out of.

9. Intellectual property

All photography, copy, and the GiftBasketsSpain.es wordmark are the property of GiftBasketsSpain.es S.L.

10. Liability

Our total aggregate liability per order shall not exceed the total value paid for that order. We are not liable for delays caused by severe weather or other events beyond our reasonable control.

11. Governing law

This agreement is governed by the laws of Spain, and any disputes are subject to the exclusive jurisdiction of the courts of Madrid, without prejudice to mandatory EU consumer-protection provisions.
